Zion Farms and Market, Inc. dba Infinite Zion Farms (IZF), a tax exempt organization under Section 501(c)(3) of the Internal Revenue Code (IRS), is conducting the “Enter The Raffle, Grow The Garden.” luxury luggage opportunity drawing to raise funds for charitable purposes. The below information sets forth the Rules and Regulations of the opportunity drawing. By purchasing entries, the purchaser agrees to be bound by these Rules and Regulations. Interpretation and application of these Rules and Regulations by IZF is final.

 

Per IRS rules and regulations, the amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts. Therefore, ticket purchases do not qualify as deductible charitable contributions.

 

November 5th, at 11:59 pm EST is the last day for ticket sales. The winner of the opportunity drawing will be selected November 5th, at 12:30 pm EST. The chances of winning are based on the number of entries sold. The RallyUp software platform will randomly select the winner.

 

The prize winner shall assume delivery costs. These must be paid prior to the prize being delivered to the winner. IZF takes no responsibility for any tax liabilities or costs. By entering this opportunity drawing, participants accept and agree (1) to be bound by all rules, regulations, limitations and restrictions set forth here and (2) to permit disclosure and use of names and/or likenesses by IZF for publicity purposes and in lists of prize winners published in media outlets/platforms and announced on the IZF opportunity drawing website. By entering this opportunity drawing, each participant releases IZF, its directors, officers, and agents from any and all liability for injuries, losses or damages of any kind resulting from participation in the opportunity drawing, or winning the luxury vehicle or related acceptance, possession, use or misuse of the prize. In addition, the winner agrees to indemnify and hold IZF harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with, or as a result of, participating in the raffle or the winner’s acceptance or use of the prize.

 

Entries:

The RallyUp software platform is the primary means for purchasing entries. IZF reserves the right to reject any purchased ticket entry submitted with inadequate payment details. Prior to the Prize drawing, IZF will make a reasonable effort to notify the individual and/or entity that submits such an entry form or one which has been rejected because the credit card or electronic payment did not clear that the entry has been rejected by attempting to make contact through the information provided at the time of submitting the purchase request. All orders for entries must be received and/or purchased by the indicated deadline. IZF assumes no responsibility for lost, late, misdirected messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines.

 

A raffle participant’s sole and exclusive remedy for IZF’s breach shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall IZF, its directors, officers, employees, agents or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.

 

How to Purchase:

An individual can purchase as many Raffle entries as he or she may wish, subject to availability. To purchase Raffle entries: use the order form provided online at https://zion.rallyup.com/zion-raffle or by texting” “zion22” to 855-202-2100 (standard texting charges will apply). IZF reserves the right to reject any entry form that is submitted with payment that does not constitute “good funds”. No refunds will be made except under the following circumstances: any ticket order with payment received after November 5th, at 11:59 pm EST, will be returned. No other refunds are available except in the exclusive discretion of IZF. IZF assumes no responsibility for lost, late, misdirected, or any other failure to receive orders or deliver receipts prior to the drawing deadline.

 

Selection of Winners: 

Zion Farms and Market, Inc.’s Louis Vuitton Bag Raffle drawing will be held on November 5th, at 12:30 pm EST, from all eligible Raffle entries. The winner need not be present to win. The winner will be notified according to the contact information provided to IZF at the time of ticket purchase. If the Prize winner cannot be located by 5:00 p.m. EST, November 5th, after making a reasonable attempt to make contact through the information provided at the time of purchasing the Raffle ticket, another winner will be selected for such prize. Should the Prize winner not claim the prize within 75 days of the Prize drawing date (January 18, 2023), the Prize will be forfeited and another winner will not be selected. In addition to the winner’s name being posted on the IZF Raffle website, the winner’s name may also be obtained from IZF or by sending a self-addressed, stamped envelope to Zion Farms & Market, Inc. PO BOX 605, Oakland, FL 34760  within one week of the drawing.

 

In order to collect the prize, a Raffle ticket winner may be required to sign and deliver to IZF:  (a) a sworn affidavit of eligibility in accordance with these Rules and applicable law, including without limitation that he or she is at least 18 years old at the time he or she purchased the winning Raffle ticket; (b) such written information as is required by any applicable tax and/or real estate laws, including without limitation his or her Social Security Number; (c) proof of identity in forms satisfactory to IZF showing that the person claiming the prize is the same person who is named on the winning Raffle ticket.; and (d) the winning Raffle ticket stub. The Prize winner may be required to submit a W-2G, Form 5754 or similar tax form (provided by IZF) for tax withholding purposes. 

 

Winning Odds:

The odds of winning a prize will depend on the number of Raffle entries sold. If fewer entries are sold, the chance of winning the Grand Prize improves. 

 

Eligibility:

Anyone 18 years of age or older at the time of the purchaser’s Raffle ticket purchase may enter. IZF Board of Directors are not eligible to win the prize. All federal, state, and local laws and regulations apply. The Raffle is void where prohibited or restricted by law. An affidavit of eligibility may be required from prize winners.

 

Prize:

The Prize is a Louis Vuitton Horizon Soft Duffle 55; no cash option is available. The Prize Winner must make an election in writing no later than 5:00 p.m. November, 6 2022 at 12:30 pm EST. The winner is also solely responsible for any pickup or delivery costs. The bag is subject to availability at the Louis Vuitton retail outlet selected by IZF and may be substituted with a comparable rolling duffle by IZF.

 

General Terms and Conditions: 

The bag will be transferred to the Prize winner “as is, where is, and with all faults.” IZF does not make or provide any representation, guarantee or warranty, expressed or implied, in connection with the Louis Vuitton bag and accepts no liability or responsibility regarding the construction or condition of the Louis Vuitton bag. IZF does not warrant that the Louis Vuitton bag is of mercantile quality or that it can be used for any particular purpose. No express warranties are given and no affirmation of IZF by words and/or actions will constitute a warranty. IZF makes no guarantee that the Internal Revenue Service (IRS) will accept the value of the Louis Vuitton bag for the purpose of determining any income tax that may be due from the winner. IZF takes no responsibility for any tax liabilities. Consult your tax advisor.

 

ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE CONTRACT, OR THE BREACH THEREOF, SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (PURSUANT TO ITS EXPEDITED PROCEDURES) UNDER ITS COMMERCIAL ARBITRATION RULES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.

 

By purchasing a raffle entry and choosing to participate in the raffle, each raffle participant acknowledges and agrees that IZF has the right, in its sole discretion, to elect not to proceed with the raffle for any reason whatsoever or for no reason, and in such event, a participant’s sole and exclusive remedy shall be to receive a refund of the full price paid by such participant for each raffle ticket purchased, without interest.
